JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 This modification application has been filed by petitioner who was opposite party no.2 in Cr. Misc. No. 36613 of 2018 for modification of order dated 20.08.2018 passed in Cr. Misc. No. 36613 of 2018.
Ground for modification is that the petitioner Cr. Misc. No. 36613 of 2018 was directed to surrender before the court below along with a bank draft of Rs.1 lac payable in the name of opposite party no.2/petitioner of this application within a period of six weeks and further directed to deposit Rs.2 lacs within two months payable in the name of opposite party no.2/petitioner of this application, but when the petitioner in the
Patna High Court CR. MISC. No.27999 of 2019(2) dt.08-05-2019 2/2 present modification application, who was opposite party no.2 in that application prayed before the court to release the amount in his favour, the same has not been released on the plea that there is no such order.
Having heard both sides, in view of the facts and circumstances of the case, this modification application is allowed.
The aforesaid amount if deposited be released in favour of the petitioner of the present case, who are opposite party no.2 in earlier case on his filing undertaking that he will be abide by final outcome of this case.
