2. Petitioner seeks regular bail in connection with Manjhagarh P. S. Case No. 169/2022 in a case registered for the offence punishable under Section 395 of the Indian Penal Code read with Section 27 of the Arms Act.
3. Prosecution case, in brief, is that on 29.05.2022 at about 2:30 PM, six miscreants came on motorcycle and looted gold and silver ornaments worth Rs. 55,60,000/- and cash of Rs. 95,000/- from jewellery shop of the informant and thereafter, fled away from the spot.
4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and his name transpired during course of investigation on the basis of confessional statement of co-accused Ajay Kumar Singh. It is next submitted
Patna High Court CR. MISC. No.33326 of 2024(2) dt.21-06-2024 2/2 that no incriminating material has been recovered from conscious possession of the petitioner and he is in custody since 13.02.2024.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh P.
