JUSTICE PARTHA SARTHY ORAL ORDER 03-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Singheshwar P.S. Case no. 227 of 2018 registered under section 392 of the Indian Penal Code.

As per allegation in the FIR, while the informant was returning on his motorcycle, three accused persons overtook him and on the point of pistol dispossessed him of his valuables.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation on the confessional statement of co-accused made before the police. It is submitted that no incriminating article has been recovered from the possession of the petitioner and the case of the petitioner stands on a similar footing to that of co-accused Monu Singh who has been enlarged on bail by order dated 20.10.2020 passed in Cr. Misc. no. 27013 of 2020. The petitioner is in

Patna High Court CR. MISC. No.29920 of 2020(3) dt.03-12-2020 2/2 custody since 22.7.2019.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner being in custody since 22.7.2019 and grant of bail to the co-accused, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Singheshwar P.S. Case no. 227 of 2018 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura.
