Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioners are apprehending his arrest in a case registered for the offences punishable under Sections 324, 307, 504/34 of the Indian Penal code and Section 27 of the Arms Act. The allegation against the petitioners is that they had assaulted the informant's side and had fired but it did not hit
Patna High Court CR. MISC. No.39787 of 2021(3) dt.26-10-2021 2/2 and, specifically, allegation against the petitioner No.2 is that he had again fired which hit the informant on his left leg. Learned counsel for the petitioners submits that they are next-door neighbours and there is a long history of enmity. Learned counsel for the petitioners also submits that there is main allegation of firing upon petitioner No.2, Ankit Lal Dev @ Ankit Kumar.
In the facts and circumstances of the case, there is direct allegation against petitioner No.2, hence, the prayer for bail as against petitioner No.2 is hereby rejected. So far as prayer for bail as against petitioner No.1 and 3 are concerned, it is allowed and in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Bahadurpur P.S. Case No.208 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
