The petitioner apprehends his arrest in Sangrampur P.S. Case No. 197/2017, instituted for the offences punishable under Sections 341, 379, 307, 504, 506 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

In the written report, it is alleged that while the informant along with her husband were returning from market, coaccused Panamati Devi and her husband Hoshila Tiwari suddenly appeared and surrounded them. It is further alleged that they abused the informant and her husband. In the meantime this petitioner along with others arrived on a motorcycle. It is alleged

Patna High Court Cr.Misc. No.44343 of 2018 (2) dt.27-07-2018 2/2 that co-accused Shashikant Tiwari opened fire which hit on the jaw of the husband of the informant. Petitioner Chhotan Pandey also made firing, which hit the waist of the husband of the informant. Thereafter, they fled away by snatching golden chain from the neck of the informant. The injury report has been annexed as Annexure- 2 which shows that the husband of the informant sustained gun shot injuries on the left buttock and right cheek.

Considering the aforesaid facts and circumstances, the anticipatory bail petition of the petitioner is rejected. The petitioner may surrender before the court below and seek regular bail, which shall be considered by the court below in accordance with law without being prejudiced by this order.
