JUSTICE SANDEEP KUMAR ORAL ORDER 27-06-2023 Heard learned counsel for the petitioner and learned counsel for the O.P. No. 02 Shri Rajendra Prasad. After some arguments, learned counsel for the petitioner seeks permission for withdrawing this application with a liberty to the petitioner to raise all his grounds at the stage of framing of charge.

Permission is granted.

Accordingly, this application is dismissed as withdrawn.

The learned Sub-Judge concerned who is hearing the Title Suit No. 184 of 2013 is directed to conclude the title suit

Patna High Court CR. MISC. No.46623 of 2018(3) dt.27-06-2023 2/2 within six months by hearing it on day to day basis. If the defendant does not co-operate in the disposal of the title suit, then the sub-judge will proceed ex parte in the matter.

The sub-judge will send a report to this Court after three months regarding the progress in the title suit. Let a copy of this order be communicated to the District Judge, Patna through FAX and e-Mail for its compliance forthwith.
