The petitioner has preferred this application for grant of regular bail in a case registered under sections 448 and 354B of the Indian Penal Code and sections 4 and 6 of the POCSO Act.

As per the prosecution case, the petitioner is stated to have molested the minor daughter of the informant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No such occurrence as alleged has taken place. The petitioner is in custody since 30.4.2021 and has no criminal antecedent. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the nature of allegation, the petitioner having remained in custody for over 8 months and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with K Nagar P.S. Case no. 180 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge-cumSpecial Judge, POCSO Act, Purnea.
