Ms. Rita Verma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 15-06-2023 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Sessions Trial No. 77 of 2023 arising out of Khagaria (Mufassil) P.S. Case No. 1047 of 2022 dated 08.10.2022 registered for the offence punishable under Sections 363 and 366A of the Indian Penal Code.

The allegation against the petitioner is that he kidnapped the minor daughter of the informant with the help of other co-accused person enticing her.

Learned counsel for the petitioner submits that there is no involvement of the petitioner in the alleged occurrance and the victim girl herself went with the petitioner and solemnized

Patna High Court CR. MISC. No.30769 of 2023(2) dt.15-06-2023 2/2 marriage with him without any pressure. In her statement under Section 164 of the Cr.P.C. the victim girl herself stated that she had gone with the petitioner and not made any allegation of any overt act against him. Petitioner is in jail custody since 09.10.2022, having no criminal antecedent. Chargesheet has already been submitted against the petitioner and there is no chance of absconding the petitioner or tampering with the evidence.

Learned APP appearing for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, let the petitioner above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VIIth, Khagaria in connection with Sessions Trial No. 77 of 2023 arising out of Khagaria (Mufassil) P.S. Case No. 1047 of 2022.
