JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks pre-arrest bail in connection with Bhorey P. S. Case No. 175 of 2014 registered under Sections 147, 148, 354, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that six co-accused, namely, Anil Ram, Pinki Devi @ Rinki Devi, Antima Kumari, Bidyawati Devi, Manorma Devi and Udiya Devi @ Raj Mati Devi having identical allegation to that of the petitioner have already been granted pre-arrest bail by a co-ordinate Bench of this Court vide order dated
Patna High Court Cr.Misc. No.503 of 2018 (2) dt.11-01-2018 2/2 21.08.2015 passed in Cr. Misc. No. 33159 of 2015. It is further submitted that the petitioner has got no criminal antecedent and having got roots in the society, he is not likely to abscond or tamper with the evidence.
Learned Additional Public Prosecutor for the State opposed the prayer for grant of pre-arrest bail to the petitioner. However, he conceded that co-accused persons having identical allegation to that of the petitioner have already been granted pre-arrest bail.
Regard being had to the submissions made on behalf of the parties, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in Bhorey P. S. Case No. 175 of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
