The petitioners apprehend their arrest in connection with Tr. No. 2010 of 2022 arising out of Gopalganj Complaint Case No. 2753 of 2018, registered for the offences punishable under Sections 376, 323, 379, 341, 120B of the Indian Penal Code in which cognizance has been taken u/s 376, 511, 323, 379 of the IPC.
The allegation against the petitioner is that he committed rape upon the prosecutrix. His anticipatory bail
Patna High Court CR. MISC. No.33841 of 2023(2) dt.28-06-2023 2/2 petition was earlier rejected vide order dated 13.10.2022 in Cr. Misc. No. 24073 of 2022.
The learned counsel for the petitioner has submitted that the prayer for anticipatory bail is renewed on the fresh ground that a compromise has been made between the prosecutrix and the petitioner.
The petitioner is directed to surrender before the court below and makes a prayer for regular bail, which shall be disposed of on the same day of its filing.
