====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 328/302/34 of the Indian Penal Code.
Husband of the informant was full-brother of the petitioner. He died in unnatural circumstances. Allegation is of commission of murder by poisoning. Mother of the deceased has already been allowed bail by a coordinate Bench of this Court.
Submission is that the deceased was an alcoholic and due to excess consumption of liquor he died. There is no direct evidence that the petitioner had administered poison to the deceased. The petitioner is in custody since 14.11.2019.
Patna High Court CR. MISC. No.29400 of 2020(5) dt.22-03-2021 2/2 Investigation of the case is already complete. Considering the facts aforesaid especially lack of material for the purpose of consideration of prayer for bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Beur P.S. Case No.285 of 2013, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
