JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.
As per the prosecution case, FIR named accused persons on the point of pistol looted cash of the informant. It is further alleged that on Lallan Kumar Mallik and other accused persons conspired and committed this offence.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR and specific allegation was leveled against FIR named accused persons. Petitioner's name has figured during course of investigation on the basis of his own confession. He is in custody since 13.1.2021.
Patna High Court CR. MISC. No.39504 of 2021(2) dt.14-12-2021 2/2 Learned counsel appearing for the State as well as the informant oppose the prayer for bail. They submit that during course of investigation petitioner has confessed his guilt and the cash which was looted was public money.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Saharsa in Bakhtiyarpur Police Station Case No. 3/2021.
