Petitioner is apprehending his arrest in connection with Khijarsarai P.S.Case No.297/2018 , registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code.
FIR discloses the allegation that the petitioner and other accused persons without information to the informant cremated the dead body of his son and it is further alleged that they have killed him and given a colour of hanging. Submission of the learned counsel for the petitioner is that they have falsely been implicated in this case and further there is inordinate delay in instituting the FIR. Apart form that other similarly situated co-accused persons have been granted
Patna High Court CR. MISC. No.32070 of 2019(3) dt.25-07-2019 2/2 privilege of anticipatory bail by Co-ordinate Benches of this Court vide order dated 23.4.2019 passed in Cr. Misc. No.26330 of 2019 and order dated 4.6.2019 passed in Cr. Misc. No.35620 of 2019.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-IV, Gaya in connection with Khijarsarai P.S.Case nO.297/2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
