====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Mahua P.S. Case No. 207 of 2019 registered for the offences punishable under Sections 395/397 of the Indian Penal Cod and Section 142 of the I.P.C. was later added. As per prosecution case, on 05.04.2011 at about 12 O'clock (at night) 20 unknown criminal armed with deadly weapons entered into the house and committed dacoity in the house of informant on the point of pistol in which dacoits assaulted the son of informant causing injury to him and looted jewellery, cash and mobile phones.

It is submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. The name of the petitioner has come on the basis of the confessional statement of coaccused Md. Jaffar Qurashi and no stolen article has been

No.29044 of 2020(2) dt.02-12-2020 2/2 recovered from the possession of the petitioner and the petitioner has no criminal antecedent as stated in paragraph No. 3 of the petition. It is further submitted that other similarly situated co-accused have been granted bail by this Hon'ble High Court.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vaishali in connection with Mahua P.S. Case No. 207 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
