The petitioner was given Rs. 20,000/- under Indira Awas Yojna for construction of the house, which he has not done in accordance with the scheme. It is not in dispute that the petitioner belongs to a weaker section of the society. The money was released in his favour at different stages. Notice No.184, dated 19.03.1997 was given to the petitioner of constructing the house according to specification. According to notice roof was to be constructed by means of cement, rod and stone chips but he used tiles and woodenbar and direction was given to dismantle the roof and cast the roof as per specification.
As it appears that the petitioner had already
Patna High Court CWJC No.3255 of 1997 dt.10-02-2015 2/2 constructed his house even not as per specification it will not appropriate to re- construct the roof after dismantling. In this view of the matter the order dated 19.03. 1997 passed by Block Development Officer, Khushrupur is hereby quashed.
The application is allowed.
