The petitioner seeks bail in connection with Sessions Trial No. 606/2019 arising out of Bettiah Muffasil (Manuapul) P.S. Case No. 120 of 2019 instituted for the offences under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(I-b) a, 26 and 35 of the Arms Act. The petitioner is said to have been arrested while

Patna High Court CR. MISC. No.31100 of 2020(2) dt.25-01-2021 2/3 trying to commit road robbery. From his possession, Rs. 14,000/- and fire arms were recovered. With respect to recovery of money, the petitioner has his explanations. The petitioner is in custody since 04.03.2019. According to the submission advance on behalf of the petitioner, even the charges have not been framed in this case.

Considering afore-stated stage of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional District & Sessions Judge, Bettiah, West Champaran, in connection with Sessions Trial No. 606/2019 arising out of Bettiah Muffasil (Manuapul) P.S. Case No. 120 of 2019.

However, it is clarified that the petitioner shall participate in the trial and his absence from trial on two consecutive occasions without seeking the permission of the Trial Court would render the bail granted to the petitioner liable to be cancelled.
