JUSTICE BIRENDRA KUMAR ORAL ORDER 25-09-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153(A), 295(A), 379, 122(B) of the Indian Penal Code. Learned counsel for the petitioners submits that there are general and omnibus allegations against the petitioners. It is alleged that these petitioners were some of the participants in procession which had started setting the shops of the localities on fire. It is submitted that for

Patna High Court Cr.Misc. No.50726 of 2018 (2) dt.25-09-2018 2/2 the same occurrence F.I.Rs. were lodged by different Magistrates, who were maintaining law and order in the locality.

Learned A.P.P. for the State is present.

Considering the general and omnibus nature of allegation, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Aurangabad (Town) P.S.Case No. 99 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
