The petitioner apprehends his arrest in connection with Chiraiya P.S. Case No. 80 of 2019 registered under Section 379 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner is quite innocent and has falsely been implicated in the present case due to village politics. Petitioner is not named in the F.I.R. Further submission is that though there is allegation against the petitioner under section 379 of the Indian Penal Code, but there is no recovery from the conscious possession of the petitioner. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.28004 of 2019(2) dt.29-04-2019 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Dhaka at East Champaran, Motihari in connection with Chiraiya P.S. Case No. 80 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
