JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-01-2021 In view of the supplementary affidavit filed on behalf of the petitioner, in the first paragraph and prayer portion of this application, in place of "Jhanjharpur (Arariya Sangram) P.S. Case No.69 of 2019", it be read as Jhanjharpur (Arariya Sangram) P.S. Case No.67 of 2019".

Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Jhanjharpur (Arariya Sangram) P.S. Case No.67 of 2019 registered under Sections 406, 409 and 420 of the Indian Penal Code. The accusation is that the petitioner being the proprietor of Ambika Traders, under agreement under Nal-Jal Yojana, for the supply of the materials, received Rs.6,50,000/- but he supplied the materials of lesser amount and the supplied materials were found of

Patna High Court CR. MISC. No.25468 of 2020(4) dt.30-01-2021 2/2 inferior quality.

Learned counsel for the petitioner submits that the petitioner, under agreement under Jal-Nal Yojana, supplied the materials of Rs.6,50,000/-, which has also come in course of investigation, the details of which are mentioned in the case diary, which is upto paragraph-55. So far as the supplied materials were found of inferior quality, as alleged in the F.I.R., is concerned, there is no description of the same in the case diary. The petitioner has no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arariya, in connection with Jhanjharpur (Arariya Sangram) P.S. Case No.67 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
