JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Uphara P.S. Case no. 55 of 2015, registered under Sections 302 and 201/34 of the Indian Penal Code.
The accusation is that informant performed the marriage of his daughter with Dhanoj Kumar, son of Rajeshwar Yadav (Petitioner No.1) in the year 2003. After the marriage, she was being tortured for demand of motorcycle and cash of Rs. 50,000/- and lastly his daughter was killed in collusion with other family members. Learned counsel for the petitioners submits that it would appear from the F.I.R. that the marriage of daughter of the informant was performed with Dhanoj Kumar, son of the petitioner No. 1 in the year 2003. Due to suffering from diarrhea she was rushed for treatment
Patna High Court Cr.Misc. No.54161 of 2017 (2) dt.14-11-2017 2/2 at the clinic of Dr. N.P. Sinha situated at Patna and she died in course of treatment, but with ulterior motive the informant lodged the present case. Further submission is that petitioners are father-in-law and brother-in-law of the deceased.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the SDJM, Daudnagar, Aurangabad in connection with Uphara P.S. Case No. 55 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
