JUSTICE PARTHA SARTHY ORAL ORDER 30-09-2020 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The instant application for regular bail has been filed by the petitioners in connection with Laukaha P.S. Case No.89 of 2020 registered under section 307 and other sections of the Indian Penal Code and section 3 of the Epidemic Act. As per allegation in the FIR, on the police personnel going to the place of occurrence to enforce the lock down as a result of Covid epidemic and on asking accused persons who were 15 to 20 in number, not to work in a group, it is stated that the 12 named accused persons including the three petitioners herein as also one Shrawan Kumar Ram and 4 to 5 unknown persons assaulted the police personnel causing injuries.

Patna High Court CR. MISC. No.25745 of 2020(2) dt.30-09-2020 2/2 It is submitted by learned counsel for the petitioners that the allegations as levelled in the F.I.R. are false and concocted. The petitioners have no criminal antecedent. They are in custody since 27.3.2020, chargesheet has been submitted in the case and their case stands on a similar footing to that of co-accused Shrawan Kumar Ram who has been enlarged on bail vide order dated 30.6.2020 (Annexure-2) passed in Cr. Misc. No. 21209 of 2020.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioners together with the grant of bail to co-accused, this Court is inclined to enlarge the petitioners on bail. The three petitioners are directed to be enlarged on bail in connection with Laukaha P.S. Case No.89 of 2020 on their furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jhanjharpur.
