====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 16-07-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Kochas P.S. Case No. 72 of 2018, instituted for the offence under Section(s) 302 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged in the written report that on the date of occurrence petitioner fired from his illegal firearms during Jaimala in marriage ceremony of Kumari Arti with Santosh Kumar, which hit on the belly of son of the informant namely, Arvind Kumar and cartridge crossed from the back of injured. It is further alleged that members of Barat Party brought him to Kochas Hospital from where he was referred to Banaras. In the way near Kargahar Mor the injured son of the informant disclosed that petitioner shot him at the time of Jaimala. The

Subsequently, son of the informant died during course of treatment in Trauma Center, Varanasi. The informant had remained busy in treatment of his son. Therefore, he could not lodge the case on the date of occurrence. Counsel for the petitioner submits that petitioner has been falsely implicated in the case due to enmity at the instance of Ajay Sharma who is accused in murder case of uncle of the petitioner Dharmendra Singh.

From the written report, this Court finds specific allegation against the petitioner of firing which hit son of the informant on account of which, he died. The injured son of the informant in way to hospital had disclosed the name of petitioner.

Therefore, this Court is not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial. S.Ali/- (Sanjay Priya, J) U T
