2. With the consent of the parties, this writ application is being disposed of at this stage itself.

3. In the present writ application, the petitioner has prayed for the grant of the following relief:- "That this is an application for issuance of an appropriate writ, order or direction, directing the

Patna High Court CWJC No.7964 of 2026(2) dt.24-06-2026 2/3 Respondents authorities to make payment of salary to the petitioner due since 09.01.2004 to 05.10.2010 with interest at the rate of 6% per annum from the date of due to the date amount is paid"

4. This is the second round of litigation by the petitioner. Earlier also, the petitioner had approached this Court, vide CWJC No.91 of 2008 and by order dated 07.12.2010 (Annexure-P/13), the petitioner was directed to file a detailed representation with regard to salary before the respondent-Magadh University and the respondent-Magadh University was further directed to consider the claim of payment of salary to the petitioner.

It is submitted by learned counsel for the petitioner that in the light of this order dated 07.12.2010 passed in CWJC No. 91 of 2008, the petitioner had filed a representation on 22.12.2010 before the Registrar of the respondent-University, which has been brought on record by way of Annexure-P/14 and the same still continues to be pending.

6. In the aforesaid backdrop, the learned counsel for the petitioner prays for withdrawing the present writ application to pursue his remedy before the Registrar of the respondentMagadh University.

7. To the aforesaid submission made by learned counsel for the petitioner, learned counsel appearing for the respondent-Magadh University and the respondent-State do not have any objection.

8. In the light of the submission made by learned counsel for the petitioner, this writ application is permitted to be withdrawn with a liberty to the petitioner to pursue his remedy before the Registrar of the respondent-Magadh University. (Alok Kumar Sinha, J) HR/- U
