JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-07-2025 Heard learned counsel appearing on behalf of the petitioner, learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant/Opposite Party No. 2.
2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 341, 323, 376, 504, 506 and 34 of the Indian Penal Code.
3. As per prosecution case, it is alleged that coaccused Arun Yadav sexually abused the informant/Opposite Party No. 2, who is a minor and this petitioner assisted him. It is further alleged that when informant along with her family members went to house of the accused persons to make
Patna High Court CR. MISC. No.29458 of 2025(3) dt.15-07-2025 2/3 complaint, co-accused Jageshwar Yadav assaulted on head of her grandfather by means of iron rod.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case merely because she happens to be mother of coaccused Arun Yadav. It is highly unbelievable that a mother would assist her son in commission of such a heinous offence. Moreover, from bare perusal of the F.I.R. it is apparent that accusation of sexual abuse is against co-accused Arun Yadav. There are general and omnibus allegations against this petitioner. Petitioner is a lady and claims clean antecedents.
5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant/Opposite Party No. 2 have vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named
