The petitioner is apprehending his arrest in connection with Raghopur P.S.Case No.18 of 2018 registered for offences punishable under Sections 341, 323, 324, 325,307,379, 504, 506, 34 of the Indian Penal Code.
Allegation against the petitioner no.1 is of assault by Garasa and against the petitioner nos. 2 and 3 there is allegation of assault.
Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and there is no specific allegation attributed against them.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.46065 of 2018 (2) dt.09-08-2018 2/2 Having heard both sides and in view of the fact that there is allegation of assault on head by the petitioner no.1 (Jeemidar Rai @ Jimdar Rai), I am not inclined to grant anticipatory bail to the petitioner no.1.
So far petitioner nos. 2 and 3 (Rakesh Rai and Panna Devi @ Panma Devi @ Ponma Devi respectively) are concerned, let the petitioner nos. 2 and 3 in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM IVth, Vaishali in connection with Raghopur P.S.case No.18 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is disposed of.
