The petitioner seeks bail in Sessions Trial No.349 of 2017 arising out of Punpun P.S. case No.269 of 2015 registered under Sections 147, 148, 149, 307, 506, 302 of the Indian Penal Code and 27 of the Arms Act, pending in the court of A.D.J. VII, Patna.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is the assailant. A report was called for from the court below regarding the stage of trial. It has been reported that out of nine prosecution witnesses seven prosecution witnesses have already been examined and the trial is expected to be concluded within a

Patna High Court CR. MISC. No.34175 of 2019(3) dt.11-09-2019 2/2 period of three months.

Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of three months from the date of receipt/production of a copy of this order. (Sudhir Singh, J) Narendra/- U T
