2. The petitioner is in custody in connection with Maner P.S. Case No. 551 of 2024 for the offence punishable under Section 103 of the B.N.S. and section 27 of the Arms Act lodged on 19.08.2024 by the informant, Aasha Devi.

3. As per the prosecution story, the informant alleged that her husband was killed by unknown criminals. The allegation is that her husband was constructing a temple at Bajipur and was living alongwith seven-eight persons therein itself. This led to the FIR.

4. Later, the investigation took place and the petitioner was picked up as it was informed by the villagers that they had a scuffle earlier and the accused persons had threatened him of dire consequences. Once the Police picked him up on

No.30467 of 2025(3) dt.06-08-2025 2/2 02.09.2024, he confesses to the crime alongwith Pankaj and further recorded that the revolver has been placed in the bushes near Bajitpur. The Police took this petitioner to Bajitpur and from the bushes, the said revolver was recovered/seized.

5. Learned counsel for the petitioner submits that the confession before the Police has no meaning and even if it is taken into account, it is alleged that Pankaj has shot the informant's husband.

6. Learned APP opposes the prayer for bail submitting that this confessional statement has led to the recovery of the arms and as such, when the same has been corroborated/supported, it has to be taken into account.

7. Taking into account the submission of the parties as also the role of the petitioner coupled with the fact that on his confession, arms has been recovered, in that background, for the present, this Court is not inclined to extend him the privilege of bail.

8. The bail application stands rejected.
