Petitioner No.2-Kranti Singh @ Kranti Patel has already been arrested in this case. Hence, his prayer for anticipatory bail is infructuous now.
Heard the parties in virtual Court.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,324,326,307,379,504,506 of the Indian Penal Code.
Co-accused-Nikku Singh is alleged to have given a
Patna High Court CR. MISC. No.25787 of 2020(2) dt.15-10-2020 2/3 blow with Garassa at the head of Faiz Ali, the brother of the informant. The Doctor has found incised wound at the parietal area of Faiz Ali and the condition of the patient serious. Other accused person also allegedly caused injury but the Doctor has found only swellings and bruises simple in nature. Though the petitioner No.3-Mun Singh @ Munna Singh @ Vinod Singh has got criminal antecedent, however, it is stated on oath that all the cases were lodged due to property dispute by own gotiyas.
Considering the nature of allegation against petitioner No.1-Lucky Singh @ Lacky Patel and petitioner No.3-Mun Singh @ Munna Singh @ Vinod Singh, let them, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Chainpur P.S.Case No.173 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner Nos.1 and 3 shall fully cooperate with the investigation/trial of the case and also the petitioner Nos.1 and 3
