JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 06-01-2020 The petition filed on 30.07.2018 is listed for hearing for the first time today before the Court.
Heard learned counsel for the petitioner and learned counsel for the respondents.
Petitioner has prayed for the following relief: "(a) To direct the respondents to provide study materials as well as examination papers in Urdu Language for urdu medium teacher and to take examination in Urdu language for Urdu teachers, in the State of Bihar for conducting examination of
Patna High Court CWJC No.15043 of 2018(2) dt.06-01-2020 2/3 diploma in elementary education D.EL.ED.) conducted by national institute of open schooling and for evaluating the answer sheet by Urdu knowing examiners and further for direction to the respondents director ad others respondents to accept the form of the petitioners for Urdu language as option like other language which has been indicated in the letter of chief public information officer dated 30.01.2018 for which the application has been called from the teachers to submit by 15.03.2018 vide notification No.-2/2018 as well as notification No.-4/2018 dated 4.6.2018 wherein schedule for online submission of the registration fees for second year of .E.L.ED. has been issued the petitioners further pray that Urdu teachers application may be accepted without late fine and allow them to appear in coming examination in Urdu language s far examination in diploma in elementary education (D.EL.ED) and also provide materials for Urdu subjects.
(b) To grant any other relief-reliefs for which the petitioners are entitled under the facts and circumstances of the instant writ application." After the matter was heard for some time, learned counsel for the petitioner submits that petitioner shall be content if a direction is issued to the concerned respondents to consider and decide the representation, which the petitioner shall be
Patna High Court CWJC No.15043 of 2018(2) dt.06-01-2020 3/3 making afresh within a period of four weeks from today. Learned counsel for the State states that upon receipt of such request, if any, the same shall be dealt with in accordance with law, expeditiously and positively within a period of three months from the date of receipt thereof. Equally, liberty is reserved to the petitioner to take recourse to such alternative remedies as are otherwise available in accordance with law.
We are hopeful that as and when petitioner takes recourse to such remedies, as are otherwise available in law, before the appropriate forum, the same shall be dealt with, in accordance with law and with reasonable dispatch.
