Petitioner seeks bail in Buxar(M) P.S. Case No. 299 of 2018 registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1B)A/35 of the Arms Act. Informant who is a police officer in his written report has alleged that he received information that five to six miscreants have assembled with a stolen motorcycle and are planning to commit some grave crime and upon receiving such information he reached the place of occurrence at 8:15 am near the house of petitioner and as they saw the police party, all tried to flee away, however, petitioner and one other miscreant were apprehended after chase and remaining managed to flee away. Patna High Court CR. MISC. No.31128 of 2019(3) dt.17-08-2019 2/2 pistol, two mobile phones and one stolen motorcycle was recovered. Petitioner has got no criminal antecedent and is in custody since 13.10.2018.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail at this stage, hence, the prayer for bail of the petitioner is hereby rejected. However, it is observed that petitioner is at liberty to renew his prayer for bail after completing one year of jail custody.
