The petitioner seeks bail in Chapra Town P.S. Case No.253 of 2020 registered under Sections 30(a) and 41(i) and (ii) of Bihar Prohibition and Excise Act.

The police after having received information that the petitioner and one Shankar Mahto kept liquor in a hut for selling, raided the hut and recovered 70 litres of liquor from the hut. Petitioner and Shankar Mahto fled away.

The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. Petitioner is not the owner of the hut and petitioner is in jail since 07.08.2020.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner and the fact that
