02. In the present case, the petitioner is apprehending his arrest in connection with Kasim Bazar P.S. Case No. 292 of 2024 registered for the alleged offences under Section 126(2), 115(2), 352, 351(2), 109 & 3(5) of the B.N.S. and Section 27 of the Arms Act.

03. As per prosecution case, the petitioner and other coaccused persons dragged out the informant from his house and assaulted him with lathi and danda. When the wife of the informant tried to save him she was also assaulted and co-accused tore her clothes and tried to outrage her modesty. When the people started assembling, the petitioner and other co-accused persons fled away from the spot and petitioner fired in air 4-5 times.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The present case is counter blast of Kasim Bazar P.S. Case No. 293 of 2024 which was lodged by the mother of this petitioner against sons of the informant and one another co-accused person. The true fact of the case is that during immersion of idol of Goddess Durga, the sons of the informant and others in inebriated condition tried to create disturbance which was opposed by this petitioner and the sons of the informant and one other person came to the house of the petitioner and threatened the mother of the petitioner and abused his sister. In retaliation thereof, the present case has been lodged by the informant of the present case who is father of the two co-accused persons who were made accused by the mother of the petitioner. Learned counsel further submits that petitioner is a student and is preparing for competitive examination. Petitioner is having antecedent of one case but he is on bail in that case.

05. Learned A.P.P. for the State opposes the submission made on behalf of the learned counsel for the petitioner.

06. Having regard to the facts and circumstances and submission made on behalf of the parties and considering the possibility of false accusation, let the petitioner above named, in the event of his arrest or surrender before the court concerned

No.32029 of 2025(2) dt.20-05-2025 3/3 within a period of eight weeks from today, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of Court of learned C.J.M., Munger, court concerned in connection with Kasim Bazar P.S. Case No. 292 of 2024, subject to the condition laid down under Section 482(2) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
