The appellant seeks pre-arrest bail in connection with Register Case No. 21 of 2019 arising out of Sasaram (Model) P.S. Case No. 28 of 2019 registered under Sections 341, 323, 379, 504, 506, 34 of the Indian Penal Code and Section 3(i) (r) (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Submission of learned counsel for the appellant is that the appellant is innocent and has falsely been implicated in the present case with an ulterior motive. Further submission is that the appellant has no criminal antecedent. Learned Special P.P. appearing on behalf of the

Patna High Court CR. APP (SJ) No.1825 of 2019 dt.03-05-2019 2/2 State vehemently opposed the prayer of the appellant by contending that there is direct allegation of assault against the appellant.

Having heard both the sides, the facts and circumstances of the case and the nature of allegation, I am not inclined to allow the prayer of the appellant for grant of anticipatory bail.

Accordingly, the appeal is dismissed.
