The petitioners apprehend their arrest in connection with Sadar Mufassil P.S. Case No. 152 of 2016, registered under Sections 363, 366(A), 376 and 307 of the Indian Penal Code and Sections 3, 4 and 6 of POCSO Act.

The accusation is of enticing away the minor daughter of the informant by Suresh Oraon for the purpose to perform the

Patna High Court CR. MISC. No.33938 of 2019(2) dt.23-05-2019 2/2 marriage.

Learned counsel for the petitioners submits that petitioners are sister, brother-in-law, mother and brothers of coaccused, Suresh Oraon, who is said to be enticed away the minor daughter of the informant. Further submission is that the statement of victim was recorded under Section 164 of the Cr.P.C., in which, she has stated about her kidnapping by Suresh Oraon and Sujit Oraon and keeping in Dabaniya Mohalla, where petitioner nos. 1 and 2 visited, which would appear from annexure 2 to the application. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Ist Additional Sessions Judgecum-Special Judge, POCSO Act, Purnea, in connection with Sadar (Mufassil) P.S. Case No. 152 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
