JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-01-2018 Heard the learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks anticipatory bail in connection with Nayagaon PS case no. 22 of 2017 registered for the offences punishable under Section 341, 323, 386, 506/34 of the Indian Penal Code.
The allegation against the petitioner is that he along with other accused persons had assaulted the informant and had demanded a sum of Rs. 1 lac.
The learned counsel for the petitioner submits that the antecedent of the petitioner is not clean, but he is on bail in all the cases. It is further submitted that all other accused persons have been granted anticipatory bail and the petitioner is a person aged
Patna High Court Cr.Misc. No.57817 of 2017 (3) dt.09-01-2018 2/2 about 78 years, hence a lenient view be shown in the case of the petitioner.
Having regard to the facts and circumstances of the case, more particularly the fact that all other accused persons have been granted anticipatory bail, I deem it fit and appropriate to enlarge the petitioner on anticipatory bail.
Accordingly, in the event of arrest or surrender within six weeks before the concerned court, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Begusarai in connection with Nayagaon PS case no. 22 of 2017, G.R. No. 1684 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
