JUSTICE BIRENDRA KUMAR ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409, 420, 467, 468 and 120(b)/34 of the Indian Penal Code.

The complaint based allegation would reveal that initially complaint petition was filed against Rajesh Kumar Srivastava, Branch Manager of a currier service, alleging defalcation of money. After 5 to 6 months of investigation, it reveals that the petitioner used the name and paper of Rajesh Kumar Srivastava and in fact he was dealing business.

Patna High Court Cr.Misc. No.51576 of 2018 (2) dt.09-10-2018 2/2 Submission is that only suspicion is there against the petitioner. Petitioner has got no criminal antecedent and it is yet to be established whether the petitioner was involved in use of the document of Rajesh Kumar Srivastava or Rajesh Kumar Srivastava himself had used his paper.

Considering the conflicting material, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Muzaffarpur Town P.S.Case No.194 of 2004, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
