Petitioner apprehends arrest in Gangabridge Police Station Case No. 48/2017 registered for the offences punishable under Section 379 of the Indian Penal Code on the allegation that stolen Scooty of the informant has been recovered from his house.

Learned counsel for the petitioner submits that the alleged Scooty was in fact parked near the house of the petitioner and only on suspicion the petitioner has been implicated in this case.

Learned counsel for the State submits that as per paragraph 29 of the case diary during investigation, informant's

Patna High Court CR. MISC. No.29802 of 2020(2) dt.15-12-2020 2/2 stolen Scooty has been recovered from the house of the petitioner.

Considering the gravity of the allegation against the petitioner, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice. (Prabhat Kumar Singh, J) Shashi U T
