Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in K. Nagar P.S. Case No. 127 of 2020, registered for the offences punishable under Sections 307, 34 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that co-accused Uma Das stopped the motorcycle of son of informant and this petitioner is alleged to have fired upon him, causing fire arm injury on his Panjara. Thereafter both the accused persons fled away.

No.29307 of 2020(2) dt.09-12-2020 2/2 It is submitted that petitioner is next door neighbour and there is friendship between the son of informant and this petitioner and due to some differences he has falsely been implicated in this case. It is further submitted that the occurrence is alleged to have taken place in the night, but no source of identification has been disclosed.

Counsel for the State vehemently opposed the bail application and submitted that there is direct and specific allegation of causing fire arm injury to the informant's son. Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
