The petitioner has preferred this application for grant of regular bail in connection with Mahnar P.S. Case No. 84 of 2023 dated 31.03.2023 registered for the offences punishable under Section 272, 273 and 414 of the Indian Penal Code and Sections 30(a), 32(ii) (iii), 36 and 41 (i) (ii) of the Bihar Prohibition and Excise Act.
As per the prosecution case, 2999.16 litres of Indian made foreign liquor, a mobile phone and some documents were

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged truck and motorcycles. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 01.04.2023.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 84 of 2023.
The application stands allowed.
