The petitioner seeks bail in connection with Special Case No. 41 of 2016 arising out of Buxar Town P.S. Case No. 322 of 2016 registered under Sections 13(1)(a)(d) of the Prevention of Corruption Act.

Considering that several other co-accused persons having more or less identical allegation have already been granted bail by different Benches of this Court and for the selfsame charges in the departmental proceeding when the petitioner was dismissed from service, the dismissal order has been set aside by this Court, the petitioner, who is in custody since 14.03.2019 and whose custodial interrogation is not warranted, is directed to be released on bail on furnishing bail

Patna High Court CR. MISC. No.30059 of 2019(2) dt.23-05-2019 2/2 bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge-1st Vigilance, Patna in connection with Special Case No. 41 of 2016 arising out of Buxar Town P.S. Case No. 322 of 2016, subject to the conditions :

(a) that the petitioner shall attend court in accordance with the conditions of the bond executed;

(b) that the petitioner shall not commit an offence similar to the offence of the present case; and (c) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
