The petitioner seeks bail in connection with Ballia Police Station Case No.347 of 2019 registered under Section 395 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, three persons, namely, Suman Kumar, Amarjeet Kumar and Ramsakal Mahto, were apprehended by the police in connection with Teghra P.S. Case No.366 of 2019. At that time, Suman Kumar disclosed the name of the petitioner as associate and indulged in the present case and Teghra P.S. Case No.366 of 2019. Thereafter, the petitioner was remanded in the present
Patna High Court CR. MISC. No.29036 of 2020(4) dt.12-03-2021 2/2 case on 04.12.2019 and since then he is in custody. Except the confessional statement of Suman Kumar, no any cogent material has been collected by the Investigating Officer against the petitioner during the course of investigation and, on investigation, charge-sheet has already been submitted against the petitioner in the case.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Ballia Police Station Case No.347 of 2019.
