JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Fatehpur P.S. Case No. 141 of 2017, registered under Sections 341, 323, 504 and 308/34 of the Indian Penal Code. The accusation is that Md. Yunus, father of the informant, was creating the plinth for constructing the house, but her uncle, Md. Ibrahim, flowed water in the plinth. When her father, Md. Yunus, made protest then Sidhu @ Didu, Kallu @ Faiyaj and this petitioner came there and started to abuse. In the meantime, this petitioner caused injury at the forehead of the informant, Tarnum Jaha Ara, whereas Kallu @ Faiyaj also caused injury to his father and mother through danda.
Patna High Court Cr.Misc. No.57788 of 2017 (2) dt.19-12-2017 Learned counsel for the petitioner submits that, in fact, occurrence took place due to land dispute. Moreover, the allegation against the petitioner is to cause injury at the head of informant, but three injuries, as found on the person of the informant, are simple in nature.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Gaya, in connection with Fatehpur P.S. Case No. 141 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
