2. The petitioner has preferred this application for grant of regular bail in connection with Obra P.S. Case No. 443 of 2023 dated 06.11.2023 registered for the offences punishable u/s 380 of the Indian Penal Code.

3. As per the prosecution case, while the informant and her family members had gone to sleep after taking meal. In the midnight, the informant awoke on some sound and saw that the petitioner put pistol on the head of the informant and tried to snatch the mobile from beneath the pillow. On hulla, the petitioner left the mobile and took the golden chain of the informant and fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case

Patna High Court CR. MISC. No.33313 of 2024(2) dt.08-05-2024 2/2 and due to dispute with regard to the irrigation of the field which occurred prior to lodging of the present case. The petitioner and the informant are the co-villagers. No T.I.P. has been conducted by the prosecution as stated in para 16 of the bail petition. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 12.03.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Daudnagar, Aurangabad in connection with Obra P.S. Case No. 443 of 2023.

7. The application stands allowed.
