JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-07-2023 The limited prayer made by the petitioner in the present writ petition is to direct the Circle Officer, Banjariya, District-East Champaran, to dispose off the pending encroachment proceedings bearing Encroachment Case No.3 of 2020-21.

The learned counsel for the respondent-State submits that in case the aforesaid encroachment proceedings are still pending, the same would definitely be disposed off, within a stipulated time frame.

Patna High Court CWJC No.7183 of 2023(2) dt.05-07-2023 2/2 Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the Circle Officer, Banjariya, District-East Champaran, to dispose off the aforesaid Encroachment Case No.3 of 2020-21, in case the same has not already stood disposed off, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing the affected parties and in accordance with law, within a period of six weeks of receipt/production of a copy of this order.
