This is the second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier bail application of the petitioner was dismissed vide order dated 14.02.2022 passed in Cr. Misc. No. 72586/2021 with an observation that the petitioner may renew his prayer for bail after three months. Allegation as per FIR is that from a rented room of the petitioner one bag containing five pistols, magazines and a sum of Rs. 1,50,000/- were recovered. One co-accused, namely, Md. Danish was also arrested from the said room. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case by the police with oblique motive inasmuch the petitioner has been running a mobile shop and during course of business some altercation took place with the local policemen who had threatened the petitioner with dire consequences. Patna High Court CR. MISC. No.29595 of 2022(2) dt.22-06-2022 2/2 implicated in this case. He next submits that the co-accused, Md. Danish has been granted bail by this Court vide Cr. Misc. No. 25056/2022. Petitioner is in custody since 29.01.2021. Regards being had to the submissions made by the parties and taking into consideration the fact that this is the second attempt for bail on behalf of the petitioner, he is in custody since 29.01.2021 and the co-accused person has been granted bail by this Court, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, namely, MUKESH KUMAR PATEL be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIII, Patna in connection with Ram Krishna Nagar PS Case No. 39/2021, subject to the condition that the petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
