The instant application has been filed for modification of the order dated 17.10.2017 passed by this Court in Cr. Misc. 49695 of 2017.
The Petitioners were allowed anticipatory bail by the order dated 17.10.2017 passed by this Court in Cr. Misc. 49695 of 2017 in which they were directed to surrender in the Court below within a period of six weeks from the date of order, but they could not surrender within time, and, hence, prayed that time be extended for further four weeks to surrender in the Court below. Subsequently, a prayer has also been made to modify condition
Patna High Court Cr.Misc. No.62689 of 2017 (2) dt.03-01-2018 2/2 No. (ii) of the order dated 17.10.2017 passed by this Court in Cr. Misc. 49695 of 2017.
In such circumstances, further four weeks' time is granted to the Petitioners from the date of receipt/production of copy of this order to surrender before learned Additional Chief Judicial Magistrate, Vth, Rosera, Samastipur, in connection with Singhiya P.S. Case No. 145 of 2016 in terms of the order dated 17.10.2017 passed by this Court in Cr. Misc.49695 of 2017. Subsequently, condition No. (ii) of the order dated 17.10.2017 passed by this Court in Cr. Misc. 49695 of 2017 is modified to the extent that in place of condition (ii) let it be read as under: "petitioners shall cooperate in the trial and shall be present on each and every dated fixed by the court and their absence on two consecutive dates without proper and reasonable reason will be liable to cancel their bail bond".
