2. The petitioner is in custody in a case registered for the offence punishable under Sections 363 and 364 of the Indian Penal Code.
3. The allegation against the petitioner is that he kidnapped the minor son of the informant.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the minor son of the informant was recovered from co-accused Baidyanath Singh whose bail has already been rejected by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 18747 of 2024. He next submits that similarly
Patna High Court CR. MISC. No.33127 of 2024(3) dt.21-06-2024 2/2 situated co-accused has been granted bail by this Court passed in Cr. Misc. No. 28278 of 2024. Petitioner is in custody since 31.07.2023.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the fact that similarly situated co-accused has been granted bail, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Shekhar Varshi, Judicial Magistrate, Ist Class, Patnacity, Patna in connection with Bahadurpur P.S.
