Apprehending his arrest in Pusa P.S. Case No. 12 of 2014 registered under sections 376 and 511/34 IPC, the petitioner has prayed for grant of pre-arrest bail.

At the dead of night, the petitioner and another accused person intruded into the room where the informant was sleeping and after tying her mouth with a Gamcha, an attempt was made desperately to commit rape on her. An alarm was raised which brought the husband of the informant and she could save herself.

Learned counsel for the State submits that the impugned order suggests that in course of investigation the allegation was found substantiated. The case was lodged in 2014 whereas the

Patna High Court Cr.Misc. No.3163 of 2018(2) dt.16-01-2018 2/2 petitioner has approached this Court after more than 03 years. Considering the above, prayer for anticipatory bail made on behalf of the petitioner is rejected.
