ANSHUMAN ORAL ORDER 11-05-2026 Heard learned counsel appearing for the petitioner, learned counsel appearing for the State and learned counsel appearing for the respondent No.3.

Learned counsel for the petitioner submits that the petitioner has filed the present writ petition for the following relief/s :- "(i) For direction upon the Respondents, more particularly Respondent Nos.3 to place the name of the Petitioner (Roll No.227381) in the Merit Wise Waiting List of Candidates which has arbitrarily been denied to the Petitioner in spite of her being on better footing, for having better claim on the basis of her

Patna High Court CWJC No.7133 of 2026(2) dt.11-05-2026 2/3 being elder to Deepti Kumari (Roll No.223990), who has same marks (48.16) to that of Petitioner and she found place at Sr. No.329 under the Unreserved Female category in the said Merit wise Waiting List of Candidates, which suggest the action of the Respondents as apparently unreasonable, illegal, arbitrary and unjust on the face of itself in the facts and circumstances of the case discussed herein below.

(ii) For protecting the interest of the Petitioner in the and said selection process initiated through Employment Notice No.01/22 conducted by Centralized Selection Appointment Committee-cum-District and Session Judge, Patna, till the disposal of this case, in the circumstanced situation where the Petitioner is better entitled than the said Deepti Kumari (Roll No.223990) under the Unreserved category Female.

(iii) Any other relief that Your lordships deem fit necessary in the facts and circumstances of this case."

3. Learned counsel for the petitioner submits that the final result was published on 19.10.2025. Thereafter, the petitioner filed a representation seeking inclusion of his name in the waiting list, but the respondents have remained silent on the same.

4. Learned counsel appearing for respondent no.3

Patna High Court CWJC No.7133 of 2026(2) dt.11-05-2026 3/3 submits that a counter affidavit is required to be filed in the matter.

5. This Court does not find it necessary to adjourn the matter merely for the purpose of filing a counter affidavit. In the opinion of this Court, filing of a counter affidavit is not necessary, particularly when no decision has yet been taken on the representation of the petitioner.

6. Accordingly, respondent no.3 is directed to take a decision on the representation filed by the petitioner, as contained in Annexure-P/7 to the writ petition, within a period of 90 days from the date of receipt/production of a copy of this order.

7. With the aforesaid observations and directions, the present writ petition stands disposed off.
