The petitioners apprehend their arrest in Obra P.S. case No. 146 of 2017 under Section 307, 379 and other Sections of the Indian Penal Code.
The informant alleged that a meeting was going on in connection with land of temple but the accused persons became violent. The accused persons came, having armed with different weapons, and assaulted the informant and his family members and also took away different articles.
The learned counsel for the petitioners submits that there is counter version. Birju Paswan, petitioner No.1, is
Patna High Court Cr.Misc. No.63614 of 2017 (2) dt.11-01-2018 2/2 informant of Obra P.S. case No. 149 of 2017. On account of land dispute there was a free fight between the two sides and both sides sustained injuries but the injury found on the person of informant is simple in nature as has been noticed by the learned Sessions Judge in ABP No. 1079 of 2017, while granting anticipatory bail to Pramila Devi and others.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Obra P.S. case No. 146 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
